If you do not fully agree to these Terms, Privacy Policy and any other terms and conditions posted or linked to our site, you are not authorized to access or otherwise use the Site. 

You should carefully read all terms and conditions. The Terms constitute a legally binding agreement between you and Rentals in Rio.com.Br.  You are not authorized to use this Site unless you are at least 18 and able to enter into legally binding contracts.  We do not knowingly collect the information of anyone under the age of 18.
 

THIS SITE IS A VIRTUAL TRAVEL AGENCY AND ITS SERVICES ARE AN ONLINE PLATFORM THROUGH WHICH HOMEOWNERS AND PROPERTY MANAGERS ARE ABLE TO LIST THEIR PROPERTIES AND GUESTS / TRAVELERS MAY BOOK THROUGH THE SITE DIRECTLY WITH THE HOMEOWNERS OR PROPERTY MANAGERS. YOU UNDERSTAND AND AGREE THATRENTALS IN RIO IS NOT PART OF ANY CONTRACT BETWEEN HOMEOWNERS AND GUESTS, IT IS NOT A REAL STATE OR BROKER. OUR WEBSITE HAS NO CONTROL OVER THE CONDUCT OF HOMEOWNERS / MANAGERS / BROKERS, GUESTS AND OTHER USERS OF THE SITE, APPLICATION AND ANY SERVICES OF THE PROPERTIES. WE WORK FOR HOMEOWNERS AND GUESTS TO MEET ONLINE SO THEY CAN ORGANIZE DIRECTLY BETWEEN THEM, THE RESERVATION OF ANY PROPERTY. WE ARE EXONERATED FROM ANY LIABILITY TO THIS RESPECT, IN THE MAXIMUM EXTENT PERMITTED BY LAW.

MODIFICATIONS Rentals in Rio reserves the right, in its sole discretion, to modify the Site or Services or to modify these terms, including service fees, at any time and without notice. By continuing to access or use the site or the Services after knowing the modifications, or send a warning after modification, you indicate that you agree to be bound by the amended Terms. If the modified Terms are not acceptable to you, your only recourse is to stop using the Site, Application and Services.

ELIGIBILITY The Site and Services are intended exclusively for adults over 18 years. Any access or use the Site or Services by persons under 18 is prohibited. By accessing or using the Site, you represent and warrant that you are over 18 years old.

REGISTRATION BY NEW ACCOUNT OR BY FACEBOOK (Third Party Account )

To access the site, you must open an account and create your ad. This process will occur in two ways:

1 - Registering by creating a unique account on our site: http://rentalsinrio.com.br.

OR

2 - Entering by your Facebook account (Third Party Account - Content SRS).

If you decide to register on the site through Facebook ( Third Party), you understand that allowing access to the site, your Facebook account, you represent that you have the right to disclose your access to Third Party Account  to our website and / or grant the site access to your Facebook account (including, without limitation, the use for the purposes described herein), without breach by you of any of the terms and conditions governing the use of Third Party account applicable, and without forcing Http :/ / RentalsinRio.com.Br to pay any fee or linking to our website to any limitation of use imposed by those providers of outsourced services.

By granting access of http://RentalsinRio.com.Br to your Facebook account, you understand that our site will access, make available and store (if applicable) any content you provide and stored in your Facebook account, account third party ("SRS Content") that are available through the website of your Account on our website and your profile page. Unless otherwise provided in these Conditions, all Content on the SRS, if any, will be considered content of members for all purposes of these terms.

Note that if your facebook account or associated service is not available or access to Rentals in Rio for Third Party Account is terminated, Content SRS will be no longer available through the Site. However, you can disable the connection between your account at http://RentalsinRio.com.Br and FACEBOOK at any time by accessing your account.

PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD PARTY SERVICE PROVIDERS IS GOVERNED SOLELY BY (S) YOUR CONTRACT (S) (S) WITH SUCH THIRD PARTY SERVICE PROVIDERS. THIS APPLIES TO ALL THIRD PIRTY INVOLVED IN THE USE OF OUR SITE.

Remember that the Rentals in Rio makes no effort to review any Third Party Content for any purpose, including, but not limited to, correctness, legality or non-infringement, and is not responsible for any Third Party Content (SRS). We will create your account on our website and your profile page to use the website based on personal information provided or we get through a SRS as described above.

FACTUAL AND ACCURATE INFORMATION You agree to provide accurate, factual, current and complete information during the registration process and update such information to keep it accurate, current and complete. Rentals in Rio reserves the right to suspend or terminate your account and your access to our site if you create more than one (1) Account on our website or if any information provided during the registration process because it was either inaccurate, incomplete or not updated. You are responsible for protecting your password. You agree that you will not reveal your password to others by phone, email and that you will take sole responsibility for any activities or actions under your account, or not allowing such activities or actions. You will immediately notify Rentals in Rio of any unauthorized use of your account with us.

HOMEOWNERS AND PROPERTY MANAGERS’ CONDUCTS, read carefully:

a- Homeowner or property manager opens an account on our site and list their properties with partial license for its use.

b- Homeowner or property manager is obliged to list an existing property with true content.

c- Homeowner and property manager agrees to open a Paypal account.   (https://www.paypal.com/br/webapps/mpp/home) You MUST register at Paypal to provide your bank information in order to enjoy the services of the site. The noncompliance with this procedure will prevent you from receiving your payment from our renters.

d-The homeowner or property manager agrees that only when closing a deal or renting a property from our guest on our website, they will have 10% (ten percent) commission deducted from the total amount of each reservation. This amount will be debited at the time the renter makes the payment to book a property. The system will automatically deduct the commission as well as send the reservation amount by Paypal to Paypal owner’s account.  The amount credited to the owner’s account may take a few days.

Example: A traveler made a week reservation for your property and paid with credit card. The total amount he or she paid is USD1,400. The 10% commission, USD140, will be deducted for Credit card, Paypal and Website maintenance. The remaining USD1,260 will go to Paypal that will transfer to your bank account.

e- Homeowners and property managers understand that this commission is for the payment of credit card companies, Paypal and site maintenance. Without these services, it won’t be possible to make the business happen.

f-The penalty for intentionally failing to comply with the payment process will result in you paying twice more than the total amount. If Rentals in Rio realize that the payment from our renter was made directly to the client and that it has not been communicated to us because the homeowner or property manager was "SMART", it could lead to the immediate cancellation of your account on our website, as well as an online complaint about this improper conduct.

g- The rentals’ deal between each homeowner or property manager and traveler / guest will not be our responsibility. What is negotiated between traveler / guest and homeowner will be the responsibility of both parties, thus excluding any liability and damage to the http://RentalsinRio.com.Br  site.

h- Homeowner or property manager will have to take responsibility and respect the BOOKING’S CALENDAR. If you are unable to honor a period that has been booked, you shall commit to find another place for the same price so the traveler/guest will not be without a place to stay.

i-The homeowner is committed to keep the property in a clean and tidy condition before giving the keys to the travelers/guests. Before the arrival of the traveler, make sure that the common areas of your property are clean and in excellent condition. This includes changing the sheets, towels, clean bathrooms, kitchen and entire area that will be used by the guest.

j-The owner is committed to do the maintenance of the property as often as necessary. For example, the hydraulic, electric and gas systems should work perfectly. Everything needs to work without any problems for the guests during their stay.

k-The owner agrees to undertake to provide convenience and comfort for guests, such as Wi-Fi, bed quality linen and towels, as well as soap, toilet paper and water. If the travelers are satisfied with your property and services, they will likely return and refer it to another traveler.

l-The homeowners and property managers agree that photos of the ad, the type of property, number of rooms and the general description of the property, are compatible with the REAL EXPERIENCE the guest will have. You must advertise YOUR PROPERTY WITH ACCURACY AND TRUTHFULNESS.

m-The homeowner shall respond within 24 hours to all emails received.

n-The homeowner has the responsibility to make the leased property available to guests at the time of check-in that was prearranged.

o- The homeowner or property manager should be available to resolve any problem that may arise with the property during the guest’s stay or leave the contact information of a person, who can solve the problem in real time. Guests need to be well accommodated during their stay at your property.

p- Homeowners must do their best for the guests because they will be asked to comment on the quality, cleanliness and services on our website. If a review is not a good one, do not be disappointed or upset, on the contrary, seek to improve everything possible based on the guest’s comments. This way, the next review will be a better one.

TRAVELERS / GUESTS

a- Travelers / Guests choose a property listed on our website: http://RentalsinRio.com.Br  and book it by paying with their credit card. The amount will be stipulated by each homeowner or property manager, as well as a fee of 2% for operational costs of the website and its services. 

b- Travelers / Guests understand that they must contact the homeowner before making the reservation and be responsible for all research on the content and accuracy of the leased property.

c- Travelers / Guests understand that our site has no responsibility for the negotiation between them and homeowners or property managers.

d- Travelers / Guests understand that each property has its own HOUSE RULES, and that must be respected.

e- Travelers / Guests are aware that our site has no responsibility for the location, content or information listed on the leased property. All content and negotiation is between Guest and Homeowners.

f- Travelers / Guests understand that we will not reimburse them for the cancellation of their reservations. Our cancellation policy is 100% non-refundable. Before making a reservation, make sure that this is the right thing to do.

g- Travelers / Guests understand that Rentals in Rio will not reimburse them in case the leased property did not meet their expectations either because the property was not in the expected location, or was not clean or was in a condition other than shown in the photos.

h- Travelers / Guests are able to review the property at any time on our website. An evaluation with a friendly tone can help the homeowner or property manager to improve the condition of the property as well as the services offered. Constructive feedback is welcome and can help us to constantly improve our services.

i- Travelers / Guests may contact us at any time to make a complaint about a homeowner or property manager when they feel they were deceived or for any other relevant reason.

REAL ESTATE RENTAL CONDITIONS:

We urge all users to be responsible in the use of this website and any business conducted as a result of any listing of a property here. Any part of a transaction between a potential traveler / guest and homeowner that has an account with us, including a good location, quality of the property, condition , content, safety or legality of the properties advertised, the truth or accuracy of the listings, will not be the responsibility of Rentals in Rio. These regulation may apply to all holiday rentals in any jurisdiction.

UNAUTHORIZED USE OF THE SITE 

The license granted to users to use our website in these terms does not include the right to collect, aggregate, copy, scraper, duplicate, display or derivative use of the site nor any right of use of data mining, robots, spiders or similar tool collection and data extraction without our prior written permission; considering, however, that a limited exception from the above exclusion is provided for non-commercial public archives that use tools to gather information for the sole purpose of displaying hyperlinks to the Site General purpose instruments internet search, since each one makes from a stable IP address or range of IP addresses using an easily identifiable agent and comply with our robots.txt file. "

 Unauthorized use of the site include, without limitation, those listed below.

PROHIBITED PRACTICES

• Create more than one account. Homeowners and property managers can list more than one property in the same account.  

• Create an account with photos and content for the purpose of defrauding the guests or the system of our website with misleading information, which may give rise to civil or criminal liability;

• Do not update the calendar in real time. It is extremely important that the travelers know the days that are available so they can book a property in that AVAILABLE period.

• Book THE SAME PROPERTY FORTHE SAME PERIOD FOR MORE THAN ONE TRAVELER. In this case, the homeowner or property manager, who has an account with us, will arrange another similar property for the same price for the guest.

• Leave the travelers / guests without a property after they have already made the reservation, it is totally prohibit. This conduct will result in an account termination.

• Deceive the payment system to avoid the commission fees. These fees are for credit card, Paypal and site maintenance. Without these services, the business will not be possible and the deal won’t happen. In case of confirmation of such a conduct, the homeowner shall pay a fine twice the amount.

• Rent a property without maintenance that may cause inconvenience to guests.

• Rent the property dirty.

• Refuse to listen to what the guest is demanding.

• Rent the property with old and/ or dirty bedding and towels for the guests. If it is not good for you, is not good for the guest.

• Rent the property without pillows. The ideal is to have two good pillows per person.

• Rent the property with no hot water in the shower.

• Rent the property without access to Wi-Fi .

• Rent the property without air conditioning or with an AC noisily.

• Rent the property without black-out at the window. Waking up with clarity on the face is not good for anyone.

• Rent the property without an iron and iron table.

• Rent the property without the basic kitchen appliances.

• Any use of our website or its tools and services for the purpose of booking or soliciting a rental for a property other than a property listed with a valid account here; 

• Use any robot, spider, scraper, other automatic device, or manual process to monitor, copy or save a copy of the database contents or any portion of the site;

• Use the site or post or transmit any information that is false, fraudulent or deceptive manner, including any booking or search under false pretenses, or taking any action that may be considered phishing or that would give rise to civil or criminal liability;

• Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, indecent, inflammatory, sexually explicit, pornographic or profane material;

• Violate, plagiarize or infringe our rights or any third party, including, without limitation, copyrights, trademarks, patents, trade secrets, rights of publicity or privacy or any other intellectual property rights; or

• Use or access our website in any manner that, in our sole discretion, adversely affects or may affect the performance or function of the site or any other system used by us or the site.
